The President has started revealing his plans on immigration for the next year. It sounds like he's planning on trying a do-over with Congress and attempting again to get a comprehensive immigration bill passed. He'll make the case for this in his State of the Union Address. I'm happy the President is still interested in working for change, I sincerely hope he is not making passing a reform bill his SOLE strategy. I'm reminded of Presidents in the past who regularly spoke in favor of something, but you just knew they didn't really care and were just trying to appease...

Pure talking points to appease the Hispanic base. Means nothing actually. He couldnt get it done when democratic party was in power. On the whole he is very weak.

Hello Sir/Madam,
I came to US on H1B visa and recently i switched my job.My previous employer (INDIAN Employer) is asking me to return original H1 petetion which they filed.
Can anyone please help me with below queries
1. Do i need Original petetion from previous employer for Green Card processing ?.
2 Should i return H1 petetion or not to my previous employer ?.
2. Is it legal requirement that i need to return original H1 petetion to previous employer who filed it ?.
I would really appreciate and thankful , if you clarify my doubts.

Vacation days can be counted in the 5 years. A leave of absence might not be able to be counted in the years of experience.

I am on an H-1B visa I had a confusion regarding my wife's case. She is on H4 visa and her H4 visa was extended to September, 2009 when I changed my employer (XXX) last year. However, her passport carries H4 visa which expires in Oct. 2007 (this was through my previous employer, YYY). Both our I-485 are pending and we both received our EAD last month. She wants to use her EAD to work in future.
A twist is that a consultant had filed for her H-1B this April and we don't know if her H-1B came through or not. He is not telling us. We just don't want to deal with that scumbag. Can we just ignore him and forget about it? Since her I-485 is pending she has a lawful status (Pending AOS), right? Please let me know what you think.

I applied for I-140 and I-485 in August 2007...my PD is sept. 2005, Eb3....
...I saw online the following message for I-140( I don't know what RFE was about:
Current Status: Response to request for evidence received, and case processing has resumed.
"On January 24, 2008, we received your response to our request for evidence. We will notify you by mail when we make a decision or if we need something from you. If you move while this case is pending, call customer service. You should expect to receive a written decision or written update within 60 days of the date we received your response unless fingerprint processing or an interview are standard parts of case processing and have not yet been completed, in which case you can use our processing dates to estimate when this case will be done."
My notice date for I-140 is Oct. 4th 2007 and receipt date is August 16th 2007...I've done my fingerprints in december 2007...my question is:....
......does it mean that Uscis will approve or deny I-140 within 60 days like they said above...even though the processing times for I-140 in Nebraska is Jan 2007?
What does the above message mean?
Does this mean Uscis is working on my I-140?
Could someone clarify this please? Anyone faced a similar situation?
I would highly appreciate your reply.

I recently returned from an international trip (flew into JFK), and the only document that the CIS officer asked for was my AP. Based on what my lawyers had said, the only 'required' document is your AP, although it probably doesn't hurt to have copies of the LC, I-140, I-485 (more for peace of mind!).

Well I've run a test shooting one subject with my D70 on each available white balance setting and uploaded the results to the gallery (sorry for taking up space but curiosity was killing me). Turns out the gallery read my EXIF data correctly on 2 out of the 6 pics uploaded, "Incandescent" & "Cloudy". All others read cloudy, so I'm not sure if the discrepancy is with the camera or the gallery. When I read the data on my PC they all read "manual white balance" so that's no help. Anyway, the following links contain the results:
